DMCA Policy

Effective Date: March 1, 2026

1. Overview

CypherPit LLC ("CypherPit," "we," "us") respects the intellectual property rights of others and expects our users to do the same. In accordance with the Digital Millennium Copyright Act of 1998 ("DMCA"), 17 U.S.C. § 512, we will respond expeditiously to claims of copyright infringement committed using our service.

2. Content on CypherPit

CypherPit is a sweepstakes entertainment platform that features music battles using publicly available metadata and embeddable content from third-party platforms including:

  • Spotify — Artist names, track titles, album art, and embeddable players via Spotify's official embed API
  • YouTube — Embeddable music videos via YouTube's official embed (youtube-nocookie.com)

We do not host, store, or redistribute copyrighted audio or video content. All music playback occurs through official embeds provided by the respective platforms under their terms of service.

3. Filing a DMCA Takedown Notice

If you are a copyright owner (or authorized to act on behalf of one) and believe that content on CypherPit infringes your copyright, you may submit a DMCA takedown notice to our Designated Agent. Your notice must include:

  1. A physical or electronic signature of the copyright owner or authorized agent.
  2. Identification of the copyrighted work claimed to have been infringed (or a representative list if multiple works).
  3. Identification of the material that is claimed to be infringing and information reasonably sufficient to locate it on CypherPit (e.g., URL, artist name, track title).
  4. Your contact information: name, address, telephone number, and email address.
  5. A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  6. A statement, made under penalty of perjury, that the information in the notification is accurate and that you are authorized to act on behalf of the copyright owner.

5. Counter-Notification

If you believe that material removed (or to which access was disabled) is not infringing, or that you have authorization from the copyright owner, the owner's agent, or pursuant to law, you may submit a counter-notification. Your counter-notification must include:

  1. Your physical or electronic signature.
  2. Identification of the material that has been removed or disabled and the location where it appeared before removal.
  3. A statement under penalty of perjury that you have a good faith belief the material was removed or disabled as a result of mistake or misidentification.
  4. Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the federal district court for the judicial district in which your address is located, and that you will accept service of process from the person who filed the original DMCA notice.

Upon receipt of a valid counter-notification, we will forward it to the original complainant. If the original complainant does not file a court action within 10 business days, we may restore the removed content.

6. Repeat Infringers

CypherPit will, in appropriate circumstances, disable and/or terminate the accounts of users who are repeat infringers. A repeat infringer is a user who has been notified of infringing activity more than twice and/or has had content removed from our platform more than twice.

7. Warning: Misrepresentation

Under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material or activity is infringing, or that material or activity was removed or disabled by mistake, may be subject to liability for damages, including costs and attorneys' fees. If you are unsure whether content on CypherPit infringes your copyright, we recommend consulting with an attorney before filing a DMCA notice.

8. Artist Takedown Requests

If you are an artist (or authorized representative) and wish to have your music removed from CypherPit battles — even if no copyright infringement is alleged — we will honor your request. Contact us at legal@cypherpit.com with:

  • Your artist/stage name and any relevant Spotify or YouTube URLs
  • Proof of identity or authorization (e.g., management email, label letterhead)
  • A clear statement that you wish to be excluded from CypherPit

We will remove the artist from active and future battles within 5 business days and add them to our exclusion list to prevent future inclusion.

9. Modifications

CypherPit reserves the right to modify this DMCA Policy at any time. Changes will be posted on this page with an updated effective date. Your continued use of the platform after changes constitutes acceptance of the modified policy.
